Council, 5‫‏‬Iyar 5708 –
May 14, 1948

I‫ ‏‬mmediately following the declaration of independence, the Provisional State
Council enacted a law and administration ordinance which established the
authority of the Provisional State Council and of the Provisional Government.
Its three sections nullified the provisions of the British government's White
Paper of 1939, which had prohibited Jewish immigration to the Land of
Israel and restricted the sale of land to Jews, and stated that until new laws
were legislated, the existing laws of Palestine would remain in force. The
members of the Provisional State Council then signed the Declaration of
Independence, and the ceremony ended.
‫"‏‬By virtue of the power conferred upon the Provisional Council of State by the Declaration
of Independence which was published today, 5th of Iyar 5708, according to which the
Provisional State Council [Mo'etzet HaMedina] and the Provisional Government of the
State of Israel were established, the Provisional State Council hereby declares the following:

a. The Provisional State Council is the legislative authority. The Provisional State
Council is authorized to confer this power to the provisional Government for the
purpose of enacting emergency regulations.

b. The provisions of the law which derive from the White Paper of the year 1939 are
hereby declared to be null and void. Sections 13 to 15 of the Immigration
Ordinance, 1941, and regulations 102 to 107c of the Defense (Emergency)
Regulations, 1945, are hereby repealed. The Land Transfers Regulations, 1940,
are hereby repealed retroactively as of 29th Iyar 5699, May 18, 1939.

c. So long as no new laws are enacted by or on behalf of the Provisional State Council,
the law which existed in Eretz-Israel on 5th Iyar 5708 (May 14, 1948) shall
remain in force, insofar as there is nothing therein repugnant to this Ordinance
or to future laws which may be enacted, and subject to such modifications as may
result from the establishment of the State and its authorities.
